"Basic Steps to file a lawsuit in Small Claims Court"
Do you know how to file a small claims court lawsuit? It a little more complicated than making a phone call and then spending a day in court. There are some things you will have to do, the documents will need to fill, and other papers are still going to have to serve.
If you need help, contact the office of your local court clerk (look in the guide local telephone book). They must be able to help determine what needs to be done. The steps you take will be different depending on where you live. Once you submit your demand, will have to prepare before your hearing.
Once you decide you want to file suit in small claims court, go to the local court and meet with the secretary. The clerk's office will not always be in the court building itself, but you know how to get to the office to make the first phone call.
In a meeting with the secretary, he or she will give you some papers to fill. You file a lawsuit, called a "complaint." You will be called the "plaintiff" – Say this in the papers to fill. Basically, you are formally complaining that a person or business caused you harm in any way.
Make sure you're suing the right people. This may seem obvious but sometimes it can be confusing. If you've spent much time dealing with an insurance company, you may have forgotten about the person (or "party") that actually caused your injury.
When you file a lawsuit, remember that you are not suing the insurance company. You are taking to court the person responsible for incidents or injury. Because the insurance will be paying the compensation, which will be representing the defendant in court.
You've probably seen (either on television or even in life real) how people can get served with court papers. Often what happens is that a lawyer or a bailiff will serve the papers to the respondent. (There are also people whose job is to serve the documents, but they themselves do not a lawyer or bailiff.) Different states have different regulations on how documents are actually served. Often, they can not simply be mailed.
Whatever your current area regulations, remember that you will be serving the papers on the person who is actually suing, not the insurance company that will represent you in court.
