Professional Responsibility

1) Should I refuse a breathalyzer test in Rhode Island?

The answer is – it depends. There is no good definitive answer to this question in Rhode Island. The only appropriate response is that it depends on the circumstances. If you refuse the breath test, your license and / or driving privilege is automatically suspended Rhode Island After arraignment but before the hearing or disposition of the matter on the merits. If you refuse a breathalyzer test, the chances of winning are relatively scarce. In a case of alcohol, the only state that has to prove that he had probable cause to arrest you and reasonable suspicion to believe that you are operating a vehicle Rhode Island motor drunk, that you were properly read their rights, and in fact refuse the breathalyzer. Even if you refuse, the state is normally DUI criminal charge you based on the employee (s) comments. Many, but not all, of the city and towns will dismiss the criminal case of observation if they commit to take a plea for minimum sanctions (at least 6 months) at the hearing the negative.

If you lose the case breath for an offense for the first time in five years the penalty is six months to twelve months loss of license and fines and driver retraining and community service. It is also required to obtain insurance expensive in your car. The advantages of a refusal in a criminal case is that the punishment for a first option is a civil violation not a criminal conviction on your record. (Note note that a second offense refusal in Rhode Island is now a crime!)

If you take the breathalyzer test and he will be charged with a criminal DUI. These cases are much more difficult for the prosecution to prove that the refusal of breath. Your chances of winning a DUI criminal case is much larger than the negative of a case! If you take the breath, you do not automatically lose his license arraignment (as you would in a case of refusal). Only if you lose your license condemns him. In other words, you can drive in the case is ongoing. If convicted in a criminal case for DUI first offense, lose your license in any place between 3 months to 6 months.

If convicted, he must also take driving classes, do community service and get a face to your insurance vehicle. In a criminal DUI, the State must demonstrate not only probable cause to arrest, must prove beyond reasonable doubts that they were too intoxicated to operate a motor vehicle in the State of Rhode Island, and the demonstration has been properly read their rights and other legal requirements fulfilled. If you lose the criminal case of DUI, you will have a criminal conviction on your record. A criminal conviction can severely hurt employment opportunities and, in some cases, lead to the loss of a job. Furthermore, a second or third conviction for DUI / DWI will mean mandatory jail time.

2) Are there rules online brilliant in Rhode Island?

a) Yes, if you are absolutely positive they will take the breathalyzer test.

b) If someone is injured in an accident – refuse the breathalyzer.

c) If you already have a criminal DUI in the last five years, then you must refuse because they are facing the time mandatory jail.

d) If you are in a profession in which a criminal conviction could hurt his career or subject to professional discipline, ie lawyer, politician, teacher, then you should probably reject.

If the bright line rules do not apply, then what?

Use a balancing test. You need to balance their need to drive your car in front of the effects a criminal conviction will have on your life. If absolutely necessary license for their work and a criminal conviction will not affect your life, then take the test if any of the bright line rules (such as injury) being applied.

If you take the breathalyzer test, not automatically lose his license and may result in the criminal case is pending and will only lose your license if you lose the case. Their Odds of winning the criminal case and retain your license is much larger than the negative case. However, the flip side is that if you lose the criminal case, then you have a conviction on history and the potential minimum jail for a crime of a second.

3) Rhode Island allow a person to drive for work after his license is suspended for DWI or refusal?

No. There is no exception that allows a person to use your car for work while their license has been suspended.
