New Laws Affecting California Realtors 2009-10 (R)
The following information from the California Association of Realtors to be paid meet the many new laws that affect Realtors in California and their clients. These new laws were issued at the conclusion of the first half of period 2009-2010 legislative sessions. These laws are the interpretations and full details of the new legislation passed laws can be found at www.leginfo.ca.gov Internet.
REAL ESTATE
REO buyer can choose Escrow and Title: Effective October 11, 2009 to January 1, 2015. Bill 957.
The buyer in an REO transaction is free to choose their own custody and title company. A lender that subjects the buyer to use a company specifically responsible.
MORTGAGES
No Advance Fee Loan Modifications: Effective October 11, 2009 – January 1, 2013. Senate Bill 94.
This law addresses the large number of scams ask for upfront fees by prohibiting any compensation for carrying out a change loan until all services are delivered as promised. This law applies to any real estate agent and attorney.
The authors of loans regulated mortgage: from December 2010. Senate Bill 36.
Mortgage loan originators to negotiate the terms of a loan offset mortgage is now regulated by the Mortgage Licensing System, this includes the financing and residential mortgage lenders. What this means more laws and restrictions will apply to these professionals.
Mortgage Broker Restricted Activities: From January 1, 2010, Assembly Bill 260.
The fiduciary duty is a mortgage broker to put the financial interest of a borrower in the first place. It places restrictions on the provision of subprime loans price, prepayment penalties, the yield spread premiums, and negative amortization loans.
Mortgage fraud becomes a crime Status: From January 1, 2010, Senate Bill 230.
All activities of processing mortgage loans with the intention of influencing the process is seen as mortgage fraud under CA law. If convicted, the crime is punishable by one year in prison.
Reverse Mortgages: As of January 1 2010 Assembly Bill 329.
Now there are new revelations, along with other requirements under the Reverse Mortgage Elder Protection Act to be followed in any reverse mortgage transaction.
INVESTORS
60-day notice to terminate tenants Extended: Senate Bill 290.
60 days of notice a monthly residential tenant law will continue indefinitely. If the tenant has lived in a property for less than one year or is in a contract lease call, a 30-day notice is sufficient. Tenant Other approaches are also addressed in this bill.
Owner Utilities: Project Senate 120.
This bill requires some companies to notify residential tenants if the owner has been defeated in the bills would resulting in discontinuation of services. This protects a tenant not have basic services and allows the tenant to put the utilities in their names to avoid interruption service.
Mobile Park: Senate Bill 804
The authorities can not make a homeowner use a specific agent or dealer to replace a mobile home or manufactured home in an area in a mobile home park.
OTHER AREAS OF REAL ESTATE
Evaluation Oversight of the Industry: From January 1, 2010, Senate Bill 237.
Background checks on all certified appraisers. Also extends definition of what constitutes fraud assessment, including promotions, promises, threats or rewards.
Increased Homestead Exemption: From January 1, 2010, Assembly Bill 1046.
Homestead exemptions increase of $ 75,000 for individuals, $ 100,000 for married couples and $ 175.00 for people over 65, disabled or age 55 with limited income. The homestead exemption is to protect the fairness of a legal owner of the creditors.
Swimming pools: Assembly Bill 1020
This bill provides that owners of apartment buildings, condominium complexes, and others must put anti-entrapment devices pool. It also requires additional presentation of declarations of compliance.
Mechanic Liens: Bill 457 of the Assembly
New guidelines and the preparation, presentation, and implementation of a Notice of Lien mechanic.
Removing documents: Bill Assembly 1094
Corporate responsibility are protected if the property have abandoned records through shredding or erasing the information. Also is a legal presumption that the tenant will own records on the premises, even after his contract was terminated.
Plumbing Fixtures: Effective from January 1, 2014, SB 407
New disclosure requirements for installing water-conserving plumbing fixtures.
